How to file a SCC claim without having to go to the courthouse

USE THIS
SERVICE IF:
1. it's difficult for you to get to the courthouse.
2 your time is too valuable to go yourself and you don't have
anybody else to go for you.
3. you don't want to hassle the waiting line at the SCC window.
4. you don't mind not knowing at the get-go your hearing date.
5. you don't mind paying the additional cost.
6. you understand you are simply paying a private website not associated with
New York state, the NY State Unified Court system or the Small Claims Part of
the NY City Civil Court.
1. In addition to the normal filing fee of $15 for claims up to $1000, and $20 for claims $1001-$5000, you will have to pay an application fee of $12 + $1.09 or a total of $28.09 if you are filing an "Individual" claim (meaning you are not an incorporated entity).
2 If you are incorporated you must file a "commercial" claim which differs from the above only in that the claim form is yellow and is labeled CIV-SC-70 and has the word "commercial" on it, Then the filing fee will come to a total of $29.79 (postage include) Don't forget the additional $12 + 1.09 application fee for a total of $42.88.
You can pay these fees online by PayPal or credit card.
You may also pay the fees by Bank Check, Tellers Check, Certified check or if you are a lawyer by attorney's check. Make it payable to CLERK, CIVIL COURT. A PERSONAL CHECK IS NOT ACCEPTABLE.
You need to provide as always a STREET ADDRESS for the defendant since a PO BOX number is never accepted.
After you have complete the information requested you will want down load three forms available to you:
1. Instructions for filing a Small Claims/Commercial Claims Action
2. The completed form itself
3. A form which you can use to request your hearing in Day Court which is permitted if you are over 65 or disable (bring proof of age to the court).
FINALLY: you must sign and send the completed claim form WITH PAYMENT (receipts from the online payments or BANK CHECK, ETC. AND a SELF-ADDRESSED 6"x 9" envelope PRE-STAMPED with postage for 3 ounces (.39 cents x 3 as of Jan 8, 2006.)
You will receive in the mail a form called the "Instructions to Claimant" as well as a Notice inciating the date and time you can tell your story to his honor the judge. That date is usually SIX WEEKS after the day they received the form you mailed them.
